The Public Gambling Act of 1867 (PGA, 1867) is the key legal framework governing gambling practices in India. The PGA specifies that "public gambling" and the operation of communal gaming venues are criminal activities in India. However, online fantasy sports gaming is seen as an exception under the PGA, and its rules and penalties do not apply to games played by users using their own skills and knowledge.

UNCERTAINTY IN CERTAIN STATES

In several Indian states, the laws regarding skill-based games are not clearly defined. For websites offering online fantasy sports, it remains ambiguous whether they can charge users to participate. States that lack clear regulations concerning pay-to-play contests include Sikkim, Assam, Odisha, Telangana, Andhra Pradesh, and Nagaland.
